Relaxations

It is possible to approve a Building Warrant where work does not comply with the current Building Regulations by issuing what is called a Relaxation.

This is only done in exceptional circumstances if it is unreasonable to apply a particular requirement of the Building Regulations.

There are a number of cases where a Relaxation has been granted for new or existing buildings when the work necessary to meet current design requirements was unreasonable and impracticable.

Building Standards staff may approve or refuse a Relaxation Application without seeking permission from a Committee of the Council. However, the first step in processing a Relaxation Application is the issue of a draft approval or refusal and if a written objection to the draft is received the matter is then considered by Elected Members at a hearing of the appeal. Once again it is important to state that staff can advise on how to apply for an individual Relaxation and on the arrangements for any subsequent appeal should that arise.
