Enforcement
If building work is done without the necessary Building Warrant
being approved or contrary to the Building Warrant conditions
Building Standards will endeavour to resolve the problem through
discussion and consultation with those concerned. In most cases
this usually brings about a satisfactory solution to the matter
and enforcement action is not taken.
In the event of the consultation process failing or where the
safety of the occupants of a building, or the public generally,
is at risk then enforcement action is considered. Ultimately such
action could lead to the Council having work altered or removed
to put it right and recovering costs.
It is the responsibility of the owner of a building to ensure
that work is carried out in accordance with the approved plans,
Building Regulations and procedures. Where work fails to meet
Building Standards requirements there is a risk of legal penalties
so it is important to have discussions with Building Standards
and consider employing suitable and competent professionals to
carry out design work, supervision and construction.
